BA_ District Management Responsibilities
No procedure or agreement with any constituent group may supersede or abrogate the legal responsibilities of any other constituent group, the Superintendent of Schools, or the Board of Education. Any agreement and its component provisions are subordinate to any present or future Federal or Colorado State Laws or regulations or final decision of any Colorado Court or administrative agency having requisite jurisdiction and any Board policy in effect pertaining to any agreement. Each such provision will be deemed amended or severed to the extent necessary to comply with such law, regulation, or decision.
The Board of Education retains the sole and exclusive right and authority to manage the business of the School District; including, but not limited to, the right and authority to plan, direct, and control its operations; to determine the location, design, size, and number of buildings; to decide the business hours of its operation; to decide the types of education service it shall provide within limitations; to determine the starting and quitting time for employees, work schedules, and number of hours to be worked; to select, hire, layoff, assign, transfer, and promote employees to a better position; to discharge, demote, discipline, or suspend with or without pay, and to maintain discipline and efficiency of employees; to determine the number of teaching and non teaching staff; to make teaching assignments and determine class size; to introduce new or improved methods, techniques, services; to evaluate employees, and to determine the method of evaluation; to establish busing procedures and requirements; to determine whether or not to contract and/or subcontract; to discontinue or consoli-date programs; and to make reasonable rules and regulations pertaining to employees.
It is the intention of this policy to clarify that all of the rights, powers, prerogatives, and authority that the Superintendent of Schools or the Board of Education has prior to the establishment of any agreement, are retained by the Superintendent of Schools or the Board of Education and that with the exception of specific provisions of the agreement, the Superintendent of Schools or the Board of Education shall have the unrestricted right to manage the affairs of the District.
